Ms. Walsh focuses her work in Family Law, Mediation, and Collaborative Practice. The traditional adversarial approach to divorce is often emotionally charged and financially draining for both spouses. Collaborative Law is a new approach that allows the divorcing couple to work together as a team with trained professionals to resolve their disputes with dignity and respect. Each spouse has the reassurance of being represented by a specially trained Collaborative Law attorney, who will support and guide the client through the Collaborative process. The clients can also choose to add other Collaborative professionals to their divorce team, such as child specialists, financial specialists, and divorce coaches. The participation of these professionals facilitates the process by allowing for real-time assistance and problem-solving in relation to the issues that arise during Collaborative meetings.

The Collaborative Process differs from litigation in that the clients and their chosen Collaborative Professionals commit to the process and the core elements of collaboration in writing; specifically, they agree:

  • To negotiate an agreement that is mutually acceptable to both clients, without intervention by the court
  • To engage in open communication and information sharing (“hide the ball” has no place in the Collaborative Process)
  • That the Collaborative professionals will withdraw from the case if either client goes to court (This means that the clients have to hire new attorneys, financial experts, child experts, etc., and have to start over)

Ms. Walsh would be happy to explain all of your options and help you decide which one – Litigation, Mediation, or Collaborative – is best suited to meeting your goals in the divorce process.
