Penalties for Multiple DUIs

There are separate penalties for each DUI within a five-year time span:

  • First DUI offense: up to one year in jail and $2,000. License suspended for at least six months.
  • Second DUI offense: up to two years in jail and $3,000. License suspended for at least one year.
  • Third DUI offense: up to three years in jail and $3,000. License suspended for at least 18 months. This DUI offense, or a DUI that results in injury, is considered a felony DUI.

The penalty may be even greater if you are convicted of DUI and you are:

  • Transporting a minor while under the influence
  • Also convicted of a gun or drug offense
  • A minor
